Where did we obtain your data from?

We received it from you when setting up an account on our website https://levicare.sklep.pl or while placing orders in our online shop without creating an account, by phone, by email, or directly at our company's premises.

What is the purpose and legal basis for the processing of your personal data by LEVICARE?

We process your personal data because it is necessary for the performance of the contract concluded with you, including to:

•enable the provision of services by electronic means and the fulfilment of orders, including making payments for the products you have purchased,

•set up and manage your account on the online shop website, including providing account support, transaction handling and resolving any technical issues,

•process online and instalment payments,

•handle complaints, including any returns of goods,

•handle the messages you send to us,

In addition, legal regulations require us to process your data for tax and accounting purposes.

We also process your personal data for the purposes indicated below, on the basis of the legitimate interest of LEVICARE sp. z o.o., which is:

•conducting marketing activities directed at you, including direct marketing of goods,

•contacting you, including for purposes related to permitted marketing activities, through available communication channels, in particular and with your consent – by email and phone;

•ensuring the handling of payment services;

•support for credit services;

•handling your requests submitted in particular to the customer service department and through the contact form, where they are not related to the performance of the contract;

•storing data for archiving purposes, and ensuring accountability (demonstrating that we have fulfilled the obligations arising from legal regulations).

•Running the LEVICARE sp. z o.o. profile on social media (Facebook, YouTube). This data is processed solely in connection with running the profile, including to inform you about the Administrator's activity and to promote various events, services and products, as well as to communicate with users through the functionalities available on social media.

If you consent to it, we process your personal data in order to:

•collect data from websites,

•organise competitions and promotional campaigns in which you can take part.

Furthermore, if you give your explicit consent, we will process your sensitive data, i.e. data concerning your health. The data obtained in this way will be used by us solely for the performance of the contract, so that we can offer you the product that best suits your needs.

You can withdraw your consent to the processing of personal data at any time, in the same way you gave it. We will process your personal data until you withdraw your consent.

Do you have to provide us with your personal data?

We require you to provide the following personal data in order to conclude and perform the contract being concluded, and thereby fulfil the obligation:

-residential address,

-delivery address (if you do not have an account).

If for any reason you do not provide this personal data, we will unfortunately be unable to enter into an agreement with you, and consequently you will not be able to take advantage of our offer.

Where required by law, we may ask you to provide other data that is necessary, e.g. for accounting or tax purposes. Apart from these cases, providing your data is voluntary.

What rights do you have in relation to LEVICARE sp. z o.o. regarding the data we process?

We guarantee that all your rights under the General Data Protection Regulation will be fulfilled, i.e. the right to access, rectify and erase personal data, restrict its processing, the right to data portability, the right not to be subject to automated decision-making, including profiling, as well as the right to object to the processing of your personal data. You may exercise these rights when:

•with regard to a request to rectify data: you notice that your data is incorrect or incomplete;

•with regard to a request to erase data: your data is no longer necessary for the purposes for which it was collected by LEVICARE sp. z o.o.; you withdraw your consent to the processing of data; you object to the processing of your data; your data is being processed unlawfully; the data should be erased in order to comply with a legal obligation; or the data was collected in connection with the provision of electronic services offered to a child;

•with regard to a request to restrict data processing: you notice that your data is incorrect – you may request that the processing of your data be restricted for a period allowing LEVICARE sp. z o.o. to verify the accuracy of this data; your data is being processed unlawfully but you do not want it to be erased; we no longer need your data, but you may need it to establish, exercise or defend legal claims; or you object to the processing of data – until it is determined whether the legitimate grounds on our part override the grounds for your objection;

•with regard to a request for data portability: the processing of your data is based on your consent, on an agreement concluded with you, or is carried out by automated means.

You have the right to object to the processing of your personal data when:

•the processing of your personal data is based on a legitimate interest or for statistical purposes, and the objection is justified by the particular situation in which you find yourself,

•your personal data is processed for direct marketing purposes, including being profiled for this purpose.

Who do we share your personal data with?

We share your personal data with parties to the transactions you conclude with LEVICARE sp. z o.o. and with entities that support us in performing the agreement, i.e. those that provide payment, credit and insurance services, perform shipment transport services, support the operation of the LEVICARE online store, support the promotion of offers, and collaborate on marketing campaigns. We may transfer your personal data to public authorities combating fraud and abuse.

All partners who process the personal data of our users ensure data security and fulfil all obligations relating to the protection of personal data.

How long do we store your personal data?

We store your personal data for the duration of the agreement concluded with you, as well as after its termination for the purposes of:

•pursuing claims in connection with the performance of the agreement,

•fulfilling obligations arising from legal provisions, in particular tax and accounting provisions,

•statistical and archiving purposes, for a maximum period of 6 years from the date the agreement is fully performed. If we provide you with assistance in obtaining a loan, the period for which we store your data for this purpose will be equal to the period during which you apply for the loan. We store your personal data for marketing purposes until you object to such processing or until claims become time-barred.

For accountability purposes, i.e. to demonstrate compliance with the regulations on the processing of personal data, we will store the data for the period during which LEVICARE sp. z o.o. is obliged to retain the data or the documents containing it, in order to document compliance with legal requirements and to enable public authorities to verify such compliance.

Do we transfer your data to countries outside the European Economic Area?

Your personal data, such as your IP address, will be transferred outside the European Economic Area to Google LLC on the basis of appropriate legal safeguards, namely the standard contractual clauses for the protection of personal data approved by the European Commission.

Do we process your personal data automatically (including through profiling) in a way that affects your rights?

Your personal data will be processed in an automated manner (without profiling); however, this will not produce any legal effects concerning you or similarly significantly affect your situation.
